Terms of Service

1. Acceptance of Terms

By accessing or using OpFleet ("opfleet.ai"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and OpFleet.

2. Account Registration

To use OpFleet, you must create an account using a valid email address. Authentication is handled via magic link email through Supabase. You are responsible for maintaining the security of your account and for all activities that occur under it. You must provide accurate and complete information during registration.

3. Service Description

OpFleet is an AI operator fleet management platform. Customers use the Service to create, configure, deploy, and manage AI operators ("Operators") for business workflows. Operators are AI-powered agents that perform tasks on behalf of your organization as configured through the platform.

4. Subscriptions & Billing

OpFleet subscriptions start at $5,000 per month per Operator. Volume discounts are available for customers deploying five (5) or more Operators. Billing is handled on a monthly basis. You are responsible for paying all fees associated with your account. OpFleet reserves the right to change pricing with 30 days' written notice.

5. Acceptable Use

You agree to use OpFleet and your Operators only for lawful purposes. You may not:

  • Use Operators for any illegal activity or to facilitate unlawful conduct
  • Send spam, unsolicited messages, or bulk communications via Operators
  • Attempt to bypass safety mechanisms, content filters, or platform restrictions
  • Use the Service to scrape, copy, or reverse-engineer competing services
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate any person or entity through Operator interactions
  • Use Operators to generate or distribute harmful, abusive, or misleading content

6. Intellectual Property

You retain ownership of all Operator configurations, data, and content you create or upload to the platform. OpFleet retains all rights, title, and interest in and to the platform, its technology, features, and underlying infrastructure. Nothing in these Terms transfers ownership of either party's pre-existing intellectual property.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using OpFleet, you consent to the data practices described in the Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. OPFLEET DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED OUTPUT. Operators are AI-powered tools and may produce errors, inaccuracies, or unexpected results. You are responsible for reviewing and validating all Operator outputs before relying on them.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPFLEET'S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO OPFLEET IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL OPFLEET BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Termination

Either party may terminate this agreement at any time. OpFleet may suspend or terminate your access to the Service immediately if you violate these Terms. Upon termination, your right to use the Service ceases, and OpFleet may delete your data after a reasonable retention period. You may request export of your data prior to termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Washington.

12. Changes to Terms

OpFleet reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
